Terms & Conditions
These Terms and Conditions govern the supply of goods sold by BuyNewSpecs of Main Street, Athboy, Co. Meath, Ireland through our website - www.buynewspecs.ie. Please read them before you place your order as you will be bound by these Terms if we accept your order.
These Terms and Conditions in combination with the order form constitute the complete agreement between us and the customer.
You may have other rights granted by law including your statutory rights as a consumer, and these Terms do not affect those rights.
By submitting your order you confirm that you are over 18 years old and are legally able to purchase prescription glasses from Buynewspecs.
You confirm that you are not registered partially sighted or blind.
We cannot supply goods to registered partially sighted or blind people.
You agree to provide any details that are reasonably required by us in order to prove that you are legally able to buy prescription lenses.
You agree to make purchases on the Buynewspecs website using your correct name, address, date of birth and any other details requested.
We are unable to provide prescription lenses to any patient whose prescription is greater than 2 years old.
All prescriptions provided to us must have been given to you by a registered medical practitioner or registered ophthalmic optician following an eye examination.
When ordering, you must provide us with details of the relevant prescription that is to be applied to the goods.
We will rely upon the prescription provided by you, and the goods provided, will contain lenses matching the prescription that you submitted.
If requested a copy of your prescription must be provided to us.
All goods advertised for sale on this site are subject to availability. If an item that you wish to order is unavailable, we shall inform you by email or phone. The reason for unavailability is usually because we are awaiting deliveries from our suppliers.
If an item is suddenly discontinued, we will notify you by phone or email to provide you with further options or to give you a full refund.,
Some goods may be out of stock or on backorder with our suppliers and therefore occasionally may take up to 4 weeks. Should this occur or where an item is delayed we will contact you regarding the situation. Our aim is to complete orders, and deliver to you, well within this 4 week timeframe.
We shall not charge you for goods that we cannot supply for any reason. However, we will not be responsible for any damage or losses that you may suffer, if we fail to supply goods.
We have attempted to display all the goods on the site as accurately and fairly as possible. Whilst all care is taken during the photography and editing of the frame images, the actual colour may vary slightly from that shown due to differences in monitor/LCD characteristics. Logos on the lenses are on the dummy lenses only and won't be on the completed spectacles.
Images, code, layout and style are all copyright. Reproduction in whole, or in part, is strictly prohibited without written permission.
Whilst we will attempt to ensure that there are no changes to the goods to be supplied, it is possible that there might be some minor variations to the description and/or specification of the goods. This may arise by virtue of changes made by the frame manufacturers.
Limitation of Supply
We will not supply glasses to under-18 year old wearers nor to registered partially sighted, or blind people.
We only supply glasses with single vision lenses of a spherical power between +6.00 and -6.00 (dioptres) and a cylindrical power between +2.00 and -2.00 (dioptres).
We can provide prescriptions lenses outside of this range. Please notify us by email or phone with your prescription. We will then contact you with suitable lens options, competitive pricing and delivery times.
We are also unable to provide prescription lenses to patients whose prescription is over 2 years old.
Unless you otherwise enter it, we will assume a ‘PD’ measurement of 62mm for distance spectacles and 60mm for reading spectacles. We do recommend that you ask your optician to measure this for you prior to your order. How to measure your PD yourself click here
Reglazing lenses into customer's own frames is done entirely at the customer's own risk. We will not be liable for damage or loss of frames sent for reglazing. We will not be liable for any breakages occurred during the glazing process, as this is also at the customer's own risk.
Pricing and payment
All prices shown on the website are correct at the time of display
Once your order is placed, the price payable for the goods is as set out on the website, plus any charges for carriage and insurance that may apply.
Once we have accepted your order, we will not change the price that applies to such an order.
Unless we agree otherwise in writing, you must pay to us the price for the goods when placing your order. Payments to us must be made in Euros.
All prices are inclusive of VAT at 23%
We reserve the right to alter prices from time to time without notice. However, we make every effort to maintain prices but prices may occasionally move up or down depending upon changes in raw material or other processing costs.
We accept payment by PayPal, Visa, MasterCard, Laser or any other credit card identified on our site.
All credit and charge card payments are subject to validation and authorisation by the card issuer. If your card issuer refuses to authorise payment, we will not be liable for any non-delivery or delay.
We will report any suspected fraudulent transactions to the relevant authorities.
Transmission of your debit or credit card number or other data in relation to payment for the goods shall be at your entire risk. We cannot accept any responsibility or liability for failures in transmission of information, deletion, non-delivery or failure to store any communications by you
We will confirm your order by email to the email address you provided on the purchase order. Our acceptance of your order constitutes a legally binding agreement between us.

Dispatch and delivery
Unless agreed otherwise in writing;
Delivery of the goods will take place at the delivery address stated on the order form. All goods will require a valid signature if registered delivery is used on delivery.
Delivery of the goods will take place within 14 working days. This date is intended as an estimate and delivery times are not guaranteed, we will advise you on the expected delivery if the wait will be greater than 14 days.
Immediately after signing (if registered) for delivery, title of the goods will pass to you.
The risk of damage to the goods passes to you once they are delivered to the address specified in your order instructions.
You agree that we will not be liable to you for any loss, damage or charge incurred because of the late delivery of goods. We use An Post for the delivery of our items and occasionally there are delays in the delivery system.
Prices quoted on our web page include unsigned delivery to Ireland and UK.
Inspection and Fitting of Goods
Upon delivery of the goods you should carefully inspect them. If any of the goods are damaged, please contact us to inform us of the problem and do not use the goods.
For correct fitting of the frame it is advised to visit an Optician. Most Opticians will fit, but may ask for a nominal fee.
Each of the goods will contain written confirmation of the prescription of the goods. If the prescription stated, does not match the prescription ordered, please contact us by email or phone to inform us of the problem and do not use the goods.
You have the right to cancel an order within 24 hours. A full refund will be issued. Such notice may be given by email, faxing or phoning us to the number or address set out on the order form.
We want you to be totally satisfied with the goods you buy from our site. If you are not happy with the goods you have purchased, you may return them within 14 days to us for adjustment, replacement or for refund.
With Varifocal lenses (We currently do not supply varifocal lenses) our returns policy is extended to 30 days to allow for customer adaptation.
Please return goods and original dispatch note by registered delivery or courier to the address specified in the dispatch note.
Please retain a photocopy of your dispatch note for your records.
If you have misplaced your dispatch note, please contact us by email or phone.
The risk of damage to any goods you return to us will remain with you until the goods have been delivered to our premises and accepted by us.
We will refund the full cost of the frame and standard lenses on receipt of the returned goods in a satisfactory condition.
If the lens has been customised with any of our coatings, tints, bifocals, varifocals or any other additions including high index lenses, the cost of these will not be refunded unless there is a fault or quality issue with the goods.
All frames are sold with a 1 year warranty against manufacturing defect. Should a replacement frame become unavailable from our suppliers we will offer you a similar frame of equal value and we will cover replacement lenses
All our lenses are guaranteed for 1 year against manufacturing defects. Our guarantee does not cover lenses subjected to normal wear and tear or patient misuse i.e. scratches
The cost of carriage and insurance is non-refundable.
We aim to respond to any complaints or issues regarding your purchase within 5 working days.
Please quote your reference number in any correspondence.
Resale of Goods
Goods are sold on the condition that they are not resold to the public.
Nothing in these terms and conditions is to be taken to exclude or restrict rights granted to you by law in respect of goods supplied. Some goods may be the subject of additional warranties or guarantees given by the manufacturers direct to you.
Without prejudice to your statutory rights, the information contained in this site is provided without warranty and in particular we do not represent or warrant that the information is accurate, complete or current or that the use of this site will be uninterrupted or error free.
We will not accept responsibility for any damage to the goods caused by you.
The risk of damage to the goods passes to you once they are delivered to the address specified in your order instructions
We will not be liable to you for any administrative inconvenience, disappointment, indirect or consequential loss or damage arising out of any problem in relation to the goods and we shall have no liability to pay any money to you by way of compensation other than any refund we make under these conditions. This does not affect your statutory rights as a consumer.
Nothing in these Terms excludes or limits our liability for death or personal injury resulting from our negligence or any breach of the statutory implied terms as to title of goods, or for fraud or any other liability which by law we are not permitted to limit or exclude.
Our maximum liability (and that of our employees, agents and subcontractors) to you in connection with any physical damage caused to your property through the negligence of us (or our employees, agents and subcontractors) will not in any circumstances exceed Euro 1,000.
In all other cases, our total liability (including our employees, agents and subcontractors) whether in contract, tort (including negligence) and breach of statutory duty or otherwise will not exceed the price of the goods and services to which the claim relates.
In no circumstances will we (or our employees, agents or subcontractors) be liable to you for any business interruption, loss of use, loss of data, and loss of profits, contracts, goodwill or anticipated savings
You will be liable for any loss or damage to the goods from the time of delivery unless such loss or damage is caused by our negligence.
We shall not be liable for any errors made by you when entering prescription details online.
We will not take responsibility for any discrepancy caused by you when entering your Pupillary Distance.
We are not able to refund or replace any non standard prescription lenses once the order has been made and has passed the 24 hour cancellation period.

You agree that we will not be liable to you for any loss, damage or charge incurred because of the late delivery of goods. We use An Post for the delivery of our items and occasionally there are delays in the postal system.
We will meet our responsibilities under this contract within a reasonable time unless it is impossible for us to do this because of circumstances outside of our reasonable control. In particular we will not be responsible for delays caused by our suppliers.
This contract is personal to you. Nobody other than you will be able to benefit from this contract. You may not transfer your rights or the benefit of any of the provisions of this contract to any other person without our prior written permission.
Goods purchased from our site are subject to Irish Law. We make no legal provision for other countries and customers outside ROI take full and sole responsibility for compliance with the law in their own country.
We will ensure that our employees, agents and sub-contractors shall, at all times, comply with the provisions of the Data Protection Act in relation to data received from you in relation to this contract and shall only process personal data received from you where necessary to fulfill our obligations under this contract.
A cookie is just a line of text and numbers that is created by our website and stored on your computer when you visit our site. The cookie does not collect or contain personal information about you and poses no security or virus risk to your computer. When you return to our site, the cookie associates your computer with the information that you gave us when you first visited or registered and therefore helps us to remember you. This can save you time, particularly when you are shopping. Of course, you can still make full use of the site if you specifically choose not to accept the cookie on your browser
No binding contract will exist between us until we have accepted your order.
Notices served under these terms and conditions must be in writing and will be deemed to be given when personally delivered, sent by confirmed fax or 3 days after being sent by registered mail to the address set out in our Dispatch Letter / Invoice.
These terms and conditions may be subject to change at any time without prior notice to you, your affiliates, partners, companies or persons of any relationship to you.
These terms and conditions shall be governed by and construed in accordance with Irish Law.
Any failure by us to enforce any of these terms and conditions shall not affect our right to enforce the rest of these terms and conditions.
You may have other rights granted by law including your statutory rights as a consumer, and these Terms do not affect those rights.

All frames come with one appropriate case and lens cloth. Cases images are examples only and do not necessarily represent the exact case supplied.
Any communications between us regarding this contract are required to be in writing and must be sent by post, facsimile or delivered by hand. Any written communication will be treated as having been served on the person receiving it 3 working days after posting, or after at the time of transmission, (if sent by facsimile and a satisfactory transmission report is obtained) or at the time of delivery (if delivered by hand).
